A trademark registration gives its owner the right to use the trademark for the goods and services covered by the registration and to prevent others from using it; however, this right is not indefinite. Under Article 23 of the Industrial Property Code, the term of protection of a registered trademark is 10 years from the filing date, and this term is renewed for further periods of 10 years.

Renewal is a continuation of the existing registration; it is not a new application. The trademark does not go through a fresh similarity examination, is not published in the Official Trademark Bulletin and is not opened to opposition. The Office checks only whether the request was made in time and whether the fee was paid, and then records the renewal in the register.

In practice this difference is very valuable: even if your trademark was involved in a dispute with a similar mark when it was registered 10 years ago, that dispute is not reopened at the renewal stage. Trademark protection lasts 10 years from the **filing date**. The most common calculation error is to start the clock from the date the registration certificate was issued: because the examination, publication and opposition stages between filing and the certificate can take around a year, a calculation based on the certificate shifts the renewal window by months.

### The Normal Renewal Period: The Final Six Months

The renewal request is made by the trademark owner within the six months before the date on which the term of protection expires, and information showing that the renewal fee was paid within the same period must be submitted to the Office. Renewing at the start of the window, months before the expiry date, causes no loss of rights whatsoever; the new term still begins on the day the old term ends. The right strategy, therefore, is to complete the renewal as soon as the window opens.

## How Does the Trademark Renewal Process Work?

### 1. Check the Register Details

The renewal request can be made by the trademark owner recorded in the register (or their attorney). If your company's trade name has changed, your address has not been updated, or the trademark has been assigned to you but the assignment has not been entered in the register, those recordals must be completed first. Entering the renewal period with gaps of this kind is the most common cause of delay.

### 2. Decide on the Scope: Full or Partial?

A trademark can be renewed for all of the goods or services covered by the registration, or for only some of them. This is called **partial renewal**. If the conditions are met, the Office records the renewal in the register and publishes it in the Bulletin. The renewal takes effect from the day following the date on which the previous term of protection ended; no gap in protection arises. Your file, in its updated form, is protected for another 10 years.

## What Happens If a Trademark Is Not Renewed?

If the renewal request is made neither in the normal period nor in the grace period, **the trademark right ends**. The expired trademark is removed from the register and the exclusive right it conferred disappears. The only way to regain the trademark is a new application; that application enters a similarity examination from scratch, and a sign that was registered without any problem 10 years ago may well meet with refusal against today's register.

1. **Calculating the deadline from the registration certificate.** Protection runs from the filing date; if the certificate date is used instead, the window is missed.
