## What Is the Difference Between a Cost and an Investment?

The difference lies in what the spending leaves behind. A cost is spending that is used up within its period without leaving a lasting right; an investment is spending on an asset that produces future benefit and can be transferred or turned into money. The effect of an advertising campaign fades once the campaign ends; a registration leaves behind a right that is recorded in the register, runs for a defined term and can be renewed.

Trademark registration touches both sides of that definition. On day one it is an expense, and the outcome is not guaranteed: if the application is refused, the official fees paid at the filing stage are, as a rule, not refunded (Industrial Property Law No. 6769 (SMK), Article 161(4)). Once registration is granted, however, the exclusive rights of Article 7 SMK come into being; they last 10 years from the filing date and can be renewed indefinitely for successive 10-year periods (Article 23(1)).

Under the 2026 trademark fee tariff of TÜRKPATENT (Turkish Patent and Trademark Office), the official cost of the first 10 years of protection is the sum of the class fees paid at the filing stage and the single registration fee. There is no annual maintenance fee after registration; the only recurring official item is the renewal fee paid every 10 years.

The table uses item 02.01.28, the general item for the third and each further class; in applications where item 02.01.34, linked to the retail group of Class 35, applies, the amount may differ. The renewal fee is a single amount for up to two classes (02.01.23), and item 02.01.32 is added for the third and each further class. The official cost of the second 10 years consists only of the renewal fee, which for up to two classes works out to about TRY 870 a year at the 2026 tariff.

Three caveats matter. First, the per-year figure is not a payment plan; the fees are not spread over the years but paid at filing and at registration. The calculation only helps you compare the annual cost of protection with the other money you spend on the name. ## What Do You Actually Buy With a Registration?

The registration fee is not the price of a certificate but the price of a bundle of rights. Under the SMK, the owner of a registered trademark obtains the following:

- **An exclusive right of use and the right to prohibit:** the right to prohibit the use of an identical or confusingly similar sign for the goods and services covered by the registration or similar ones, which, when its conditions are met, also extends to use as a domain name or keyword online or as a trade name (Article 7(2)–(3)).
- **Civil and criminal tools:** claims to stop infringement and for damages, seizure and destruction (Articles 29 and 149), plus the ability to file a complaint for the trademark infringement offense, for which the mark must be registered in Turkey (Article 30(5)).
- **Assignment:** the mark can be assigned independently of the business, for all or some of the goods and services covered by the registration (Article 148(2) and 148(6)).
- **License income:** trademark rights can be the subject of a license agreement for the goods and services for which the mark is registered (Article 24).
- **Pledge and security:** the mark can be pledged and given as security (Article 148(1)).
- **Proof through the register:** the right is shown by the register entry, without having to prove your use again in every dispute.

### Licensing: earning from the brand without selling it

A license means granting someone else the right to use the mark by contract without transferring ownership. Under Article 24 SMK, a license can be exclusive or non-exclusive, and unless the agreement provides otherwise, it is non-exclusive. Registration becomes an investment when the name it protects is used, kept within the right scope and renewed on time. The same fee turns into a cost that will not come back when it is paid for a refused application, for a class that is never used, or for a registration taken out in the wrong owner's name. These are the steps that turn registration into an investment:

1. **Search before you file:** if the application is refused, the fees paid at the filing stage are not refunded (Article 161(4)); a similarity search makes that risk visible before filing.
2. **Build the scope around your business plan:** choose the goods and services you sell today and those you will genuinely launch in the near term; every extra class adds to the cost at filing, and the third and further classes add to it again at renewal.
3. **Register in the right owner's name:** if you are considering investment, a sale or a grant application, having the mark in the name of the relevant business makes later transactions easier.
4. **Use the mark and keep evidence:** a mark not put to genuine use within five years of registration can be revoked on request (Articles 9 and 26).
5. **Monitor the Bulletin:** if similar applications are not opposed within two months of publication (Article 18), action against a similar mark once it is registered is often possible only through an invalidation action in court (Article 25).
6. **Put renewal on the calendar:** renew within the six months before protection expires; if you miss that window, the six-month grace period can only be used with an additional fee (Article 23(2)).
