Class 44 protects the service. The most common mistake in the sector is for salons launching their own product line to stop there — which leaves use of the mark on the product unprotected.

### A salon with its own product line

### A salon with an academy

**44 + 41.** A model spreading through the sector: running the salon while offering courses and certification under the same brand. Education services are a separate class and 44 does not cover them.

### A chain planning to franchise

## Sector-Specific Risks

### 1. Distinctiveness

Sector terms carry no distinctiveness on their own: "Beauty", "Aesthetic", "Spa", "Salon", "Studio", "Care". They are stripped out in the similarity assessment and the comparison rests on the remaining core word.

So with an earlier "LUNA" on the register, an application for "LUNA BEAUTY" does not remove the similarity.

### 2. Personal name marks

If the brand name promises a medical effect that is not provided, it may be refused as deceptive. Watch for this in names edging towards the medical field.

### 4. Signage and branch security

Using the salon name on a sign gives no trademark right. When you open a second site, or when someone using the same name in another city registers it first, the unregistered party is left exposed.
