## In Brief: What Is Trademark Registration?

Trademark registration is the process of officially recording with TÜRKPATENT (the Turkish Patent and Trademark Office) the name, logo or figure that distinguishes a business's goods or services from those of its competitors. The process begins with a free preliminary search; after TÜRKPATENT examination and the 2-month bulletin/opposition period, applications that receive no opposition or refusal usually conclude with a registration certificate within 6-12 months.

Registration grants the owner an exclusive right of use valid for 10 years from the filing date and renewable, together with the standing to bring legal action.

## The Protection Provided by Trademark Registration

An unregistered trademark means no legal protection. Gain full legal security against competitors with a registration certificate.

- **Exclusive Right of Use** — Only you can use your trademark across Turkey.
- **Right to Sue** — In case of infringement you can claim damages in court.
- **International Expansion** — Expand easily into 130+ countries via the Madrid Protocol.
- **Licensing & Assignment** — You can generate income by licensing or assigning your trademark.

- **What is trademark registration?** — Trademark registration is the process of officially recording with TÜRKPATENT (the Turkish Patent and Trademark Office) the name, logo, slogan or figure that distinguishes a business's goods or services from those of others. The registration certificate grants the owner an exclusive right of use and legal protection throughout Turkey. Protection is valid for 10 years from the filing date and can be renewed for further 10-year periods.
- **Why does trademark registration matter?** — Trademark registration matters because an unregistered trademark is legally unprotected: your competitors can register the same or a similar name and bar you from using it. Registration, by contrast, grants an exclusive right of use throughout Turkey and gives you the right to sue in case of infringement, claim damages and stop counterfeit goods at customs. A registered trademark can also become a source of income through licensing or assignment.
- **Is trademark registration mandatory?** — No, trademark registration is not legally mandatory; a trademark can be used without being registered. However, unregistered use creates no exclusive right and makes proving and protecting your rights in the mark almost impossible; someone who registers the same name first can bar you from using it. That is why trademark registration is recommended for every business engaged in commercial activity.
- **How long does trademark registration take?** — Trademark registration is usually completed within 6-12 months for applications that receive no opposition or refusal. Preparing the application and filing it with TÜRKPATENT takes 1-2 business days, and the application number is issued on filing. This is followed by the Office's examination, publication in the Official Trademark Bulletin, the 2-month opposition period and payment of the registration fee. The timeline may vary with the Office's workload.
- **How much does trademark registration cost?** — Webx's trademark registration packages start from 7.000,00 ₺ + VAT; this covers the service fee and the TÜRKPATENT application-stage fee, and VAT applies only to the service fee. If the trademark is registered, 15.000,00 ₺ + VAT (including the 7.010,00 ₺ TÜRKPATENT registration fee) is charged separately at the registration stage; if it is not registered, nothing is charged. In the Money-Back Guaranteed Application package, registration-stage fees are included. The final fee depends on the number of NICE classes and the package; details are on the pricing page.
- **Which documents are required for trademark registration?** — For trademark registration, Turkish ID details for natural persons or the tax certificate or Trade Registry details for companies, the trademark logo (if any) and the list of goods and services for which the mark will be used or registered are sufficient. Documents can be uploaded digitally without visiting an office. The NICE classes are determined together with you, and our experts prepare the application form on your behalf within 1-2 business days.
- **How many NICE classes should I choose?** — How many NICE classes you choose depends on the goods and services for which you actually use, or plan to use in the near future, your trademark; we recommend filing in every class they fall into. There are 45 classes in total in Turkey, and trademark protection is limited to the classes selected. In the free preliminary search our experts determine the class combination that suits you best; the final fee also varies with the number of classes.
- **Can a trademark application be filed online?** — Yes, a trademark registration application can be made online. With Webx the entire process, including preliminary search, document upload, payment and tracking, is carried out digitally without visiting an office. The application number is issued immediately when the application is filed with TÜRKPATENT; you can follow the examination, bulletin publication, opposition period and registration steps in real time from your client portal and download a digital copy of the registration certificate there too.
- **What types of trademarks can be registered?** — Registrable trademark types are word marks, figurative/logo marks, word+figure combinations, colour marks, sound marks and three-dimensional shape marks. The common requirement is that the sign can distinguish goods or services from those of others. Descriptive or generic terms and signs contrary to public order are absolute grounds for refusal and cannot be registered (Industrial Property Law No. 6769, Art. 5); earlier similar trademarks may also constitute relative grounds for refusal (Art. 6).
- **Are trademark registration and logo registration the same thing?** — No, trademark registration and logo registration are not the same thing. Trademark registration protects the ability of a sign, whether a word, a figure or a combination of both, to distinguish the commercial origin of goods and services. A logo, on the other hand, is a design element: it can be protected as a figurative mark through trademark registration and, if its shape is new and distinctive, separately through design registration as well (Industrial Property Law No. 6769, Art. 56).
- **What is the difference between a trademark and a trade name?** — The difference between a trademark and a trade name lies in where each is recorded and what it protects. A trade name is a company's legal identity recorded in the Trade Registry and provides protection only as between trade names. A trademark is the sign that presents goods and services in the market and is protected by a separate registration with TÜRKPATENT. A company may therefore have a registered trade name yet an unregistered, and thus unprotected, trademark.
- **What happens if a trademark application is refused?** — If TÜRKPATENT refuses a trademark application on absolute grounds, the decision can be appealed within 2 months of notification (Industrial Property Law No. 6769, Art. 20). Our expert team prepares the reasoned notice of appeal and handles the appeal before TÜRKPATENT as the registered attorney. If the dispute moves to the court stage, Webx works with partner lawyers or with your own lawyer.
- **What happens if my trademark application is opposed?** — If a trademark application is opposed, that is, if third parties file an opposition within 2 months of its publication in the Official Trademark Bulletin (Industrial Property Law No. 6769, Art. 18), a counter-statement can be submitted within 1 month of the opposition being notified to you. We respond to the opposition by preparing the counter-statement; the process is handled by our Legal Protection team. TÜRKPATENT's decision on the opposition can in turn be appealed within 2 months of notification.
- **Can I register my trademark abroad as well?** — Yes, you can also register your trademark abroad. Under the Madrid Protocol, a single application based on a basic application or registration in Turkey and filed with WIPO through TÜRKPATENT can seek protection in more than 130 countries and markets; each country carries out its own examination. A single application to the EU Intellectual Property Office (EUIPO) can secure protection in all 27 EU member states, and direct filings with national offices such as the US (USPTO) are also possible.
- **Can foreign nationals register a trademark in Turkey?** — Yes. Under the principle of reciprocity, foreign natural and legal persons can register trademarks in Turkey. Applicants without a domicile in Turkey must act through an authorised trademark attorney. As Webx acts as a trademark attorney before TÜRKPATENT, it can prepare and file the application on your behalf and follow the examination, bulletin publication, opposition period and registration stages.
- **Can a trademark be used without registration?** — Yes, a trademark can be used without being registered, but such use creates no exclusive right. Unless you register it, someone else can register the mark in their own name, despite the goodwill you have built through unregistered use, and bar you from using it. Registration, by contrast, grants an exclusive right of use that is valid for 10 years from the filing date and renewable, as well as the right to sue in case of infringement.
- **What happens if I do not use my trademark after registering it?** — If a registered trademark is not genuinely used within 5 years of registration without a justified reason, or its use is suspended for 5 consecutive years, it can be revoked by TÜRKPATENT at the request of interested parties (Industrial Property Law No. 6769, Arts. 9 and 26). This is why actually using your trademark after registration, and keeping evidence of that use, matters.
- **Can a sole proprietorship register a trademark?** — Yes, sole proprietorships can register trademarks. In addition to sole proprietorships, capital companies such as joint-stock and limited liability companies, as well as natural persons, can file trademark applications in their own name. The applicant is not required to be commercially active in relation to the trademark; however, a mark that is not used for 5 years from registration without a justified reason can be revoked upon request.
- **Do I need a lawyer to register a trademark?** — No, a lawyer is not required for trademark registration; an authorised trademark attorney is sufficient at the application stage. Trademark attorneyship requires an authorisation separate from practising law (the TÜRKPATENT trademark attorney exam). Litigation and court proceedings, however, require a lawyer. Webx is not a law firm: it handles TÜRKPATENT proceedings as a registered attorney and, at the court stage, works in an advisory role alongside partner lawyers or your own lawyer.
- **Do I need registration for my e-commerce brand?** — Registration is not legally mandatory for an e-commerce brand, but it is strongly recommended. The brand registration and infringement complaint processes of marketplaces such as Trendyol, Hepsiburada and Amazon usually ask for a registration certificate or application details. Unregistered brands risk being removed from the store on unfair competition claims, whereas registration secures the brand in your name for the classes the application covers.
- **When will my trademark registration certificate reach me?** — The trademark registration certificate becomes instantly available through the e-document system following TÜRKPATENT's registration decision, and you can download the digital copy from your client portal. A physical registration certificate can be requested separately. Registration follows examination, bulletin publication, the 2-month opposition period and payment of the registration fee; applications that receive no opposition or refusal are usually registered within 6-12 months.
- **How do I track my trademark application?** — You can track your trademark application from the Webx client portal. There you can see every stage of your application at TÜRKPATENT (examination, publication in the Official Trademark Bulletin, the 2-month opposition period and registration) in real time and receive SMS and email notifications. The application number is issued when the file is submitted to TÜRKPATENT, and after registration a digital copy of the registration certificate is added to the portal.
- **What is money-back guaranteed trademark registration?** — Money-back guaranteed trademark registration is a service model available only with the Money-Back Guaranteed Application package: if an application found eligible in the free preliminary search is refused in full and cannot be registered, 100% of the payments made is refunded. All registration-stage fees are included in this package. The Single-Class and Six-Class packages carry no money-back guarantee; details are on the Money-Back Guaranteed Trademark Registration page.
- **What is the difference between trademark and design registration?** — The difference between a trademark and design registration lies in what they protect: a trademark protects a distinctive sign, while design registration protects the visual/aesthetic appearance of a product (shape, pattern, colour combination). For example, both the brand name on a package and its distinctive shape can be registered separately. Trademark protection can be renewed indefinitely for 10-year periods, whereas design protection lasts a maximum of 25 years.
- **Can I file a bulk application for more than one trademark?** — Yes, applications for multiple trademarks can be filed together and simultaneously. For our corporate clients we offer simultaneous filing of multiple trademarks and portfolio management from a single portal; special pricing applies to bulk filings. You can follow the application, opposition and renewal processes of your multi-class, multi-brand portfolio from the same portal and request a custom quote for pricing.
- **Can trademark registration be paid in installments?** — Yes, trademark registration packages can be paid by credit card in instalments, and payment by bank transfer or EFT is also accepted. The current instalment options are shown at the payment step of the order and in the package comparison on the Pricing page. If you have questions about payment methods, contact us before ordering and review the options with one of our consultants.
