Applications are compared with your trademark for phonetic, visual and conceptual similarity. The aim is to protect your rights by enabling you to act without missing the 2-month opposition period that runs from the publication date.

  • Watching is necessary after registering a trademark because registration grants a right of protection but is passive; it does not automatically protect your trademark against similar new applications. If you do not act within the 2-month opposition period against a similar application published in the Bulletin, that mark can also be registered, and the resulting confusion in the market can gradually erode your trademark's distinctiveness, reputation and commercial value. Without watching, noticing these applications is nearly impossible.

  • Trademark watch covers every new Official Trademark Bulletin TÜRKPATENT publishes; the bulletin does not follow a fixed weekly schedule but appears on dates set by the Office. Our system automatically scans every new bulletin and compares it against your trademark. If a similar application is detected, a notification is sent to you, so you can act within the 2-month opposition period that runs from the publication date.

Trademark watch is a separate, complementary service aimed at maintaining your trademark's protection after registration: it detects new applications similar to your trademark in every bulletin published and notifies you so that you can act within the 2-month opposition period.

  • It is recommended that you start trademark watch as soon as you receive the registration certificate, or even from the application stage onward. This keeps you continuously protected against similar applications throughout the process. Since the opposition period for an application published in the Bulletin is 2 months from the publication date, starting late may cause you to miss the opposition period for similar applications published in the meantime.

  • Yes, under trademark watch several of your trademarks can be watched in a single package. Every trademark in your portfolio is tracked from a single client portal with consolidated reports, and each is compared against newly published bulletins. Special pricing applies to corporate clients; our multi-brand corporate clients can also manage their opposition and renewal calendars centrally from the same portal.

  • No, opposition is not mandatory when a similar application is detected; the decision to oppose is yours. However, if you want to protect your trademark's distinctiveness and market value, opposing applications that pose a genuine risk is recommended. The similarity rate and class details in the notification guide this decision. An opposition must be filed within 2 months of publication in the Bulletin.

  • The trademark opposition process is managed by Webx's Legal Protection team, acting as your registered attorney before TÜRKPATENT. Preparing the notice of opposition and following it up before the Office are handled by this team, so the transition from the watch service to opposition is seamless.   • Yes, trademark watch is a paid service offered on a monthly or annual subscription basis. Throughout the subscription, every TÜRKPATENT bulletin published is scanned and applications similar to your trademark are reported to you. The only free service is the one-off preliminary search carried out before registration. Contact us for current pricing; special pricing applies to corporate clients.

  • Yes, since trademark watch is subscription-based, you can stop it whenever you wish. However, we recommend uninterrupted watching so that your trademark stays protected at all times. Because the bulletin is published every week and the opposition period is 2 months from the publication date, similar applications published while watching is paused may go unnoticed and their opposition deadlines may be missed.

  • Trademark watch covers only applications similar to your own trademark; not every application in your sector is reported. Watching is limited to applications bearing phonetic, visual or conceptual similarity to your trademark (word, figure or combination). Overlap in the relevant NICE classes is also taken into account, and only the applications relevant to you are reported, together with their similarity score.

  • No, the basic trademark watch service does not detect use-based infringements; it covers only new applications filed with TÜRKPATENT. Similar signs actually used in the market without any application do not appear in the bulletin and are therefore not picked up by watching. To detect such infringements, we offer a separate "infringement watch" / brand protection advisory service.

  • Whether a competitor is trying to register your trademark in bad faith is assessed in trademark watch by further analysing applications with a high similarity score. In this analysis, the applicant's sector and past filing behaviour are examined for signs of bad faith, and our experts share the result with you. An application filed in bad faith is refused upon opposition; the opposition must be filed within 2 months of publication in the Bulletin.

  • Trademark watch sends an instant notification by email and SMS when a similar application is detected; you can also see a record of every past notification in your client portal. Even if no similar application is found, a summary report is sent by email at regular intervals. Notifications go to the authorised person or persons on your account; corporate accounts can set up notifications for more than one authorised person.

  • Yes, the trademark watch service also tracks your renewal date. As the end of your trademark's 10-year protection period, which runs from the filing date, approaches, an automatic renewal reminder is sent as part of the watch service. Renewal is made within the final 6 months before expiry; if missed, it can be made with an additional fee within a 6-month grace period from expiry, and if the grace period also passes, the trademark right ends.

  • Yes, for corporate companies the trademark watch service is integrated into portfolio management. Our multi-brand corporate clients can watch their entire portfolio (trademarks, patents and designs) from a single portal and manage opposition and renewal calendars centrally. Trademarks in the portfolio are tracked with consolidated reports, and special pricing applies to corporate clients. On corporate accounts, notifications can be set up for more than one authorised person.
