What Is a Domain, What Is a Trademark?
A domain name is your website's address on the internet, leased from a registrar. It gives you the ability to use that address. Trademark registration, by contrast, grants you a legal, exclusive right over the commercial use of a name or logo for specific goods and services. In short, one is an "address" and the other is a "right".
Does Buying a Domain Create Trademark Rights?
No. Owning a domain name does not automatically give you the right to use that name as a trademark. Equally, registering a trademark does not guarantee you the matching domain. The two are managed in separate systems by different bodies.
Domain First or Trademark First?
Ideally you plan both together. In practice this strategy is the safe one:
- Once you have settled on a name, check both domain availability and trademark availability.
- If the name is clear on both sides, register the domain quickly (so it is not taken).
- Then start the trademark process; registration is what provides the lasting protection.
What If a Domain and a Trademark Clash?
If someone has registered, in bad faith, a domain containing your registered trademark, you can object on the basis of your trademark right and pursue legal routes to have the domain transferred to you or cancelled.
