The core class for clothing brands is class 25: clothing, footwear and headgear.
But the equation "clothing brand = class 25" falls short for most brands, because a fashion label's product range rarely fits into a single class.
The question that determines scope is: on which products will your mark appear?
Class Map by Product Range
| Product | Class |
|---|---|
| Clothing, footwear, hats and headgear | 25 |
| Bags, luggage, wallets, belts (leather goods) | 18 |
| Jewellery, precious stones, watches | 14 |
| Spectacles, sunglasses | 10 (moved from 9 in 2026) |
| Fabrics, home textiles, towels, bed linen | 24 |
| Sewing thread, yarn products | 23 |
| Buttons, zips, lace, trimmings, hair accessories | 26 |
| Perfume, cosmetics (as a fashion brand extension) | 3 |
| Retail, e-commerce, collection sales | 35 |
| Contract sewing, garment manufacturing | 40 |
Under Communiqué 2026/2, electrically heated socks moved from class 11 to class 25; brands with technical textile products may need to check their scope against this change.
Typical Structures
A boutique or own-design label
25 + 35. Class 25 protects use of the mark on the product; class 35 protects the retail service in your own shop or website. They are separate areas of protection and neither substitutes for the other.
A multi-brand store with no own product
Class 35 alone. Because the goods you sell carry other brands, no goods class is needed.
A fashion brand also selling accessories
25 + 18 (+ 14) + 35. If your collection includes bags and jewellery, those are separate classes. When deciding which are genuinely necessary, look at the split of turnover.
A contract manufacturing workshop only
Class 40. If you do not sell under your own brand, no goods class is needed.
Sportswear and technical textiles
25 + 28 (sporting goods) and, if relevant, 24. Class 28 arises where the product is genuinely sports equipment.
Three Risks Specific to Clothing
1. Distinctiveness — the sector's most common ground of refusal
In fashion, brand names are frequently built from words describing the sector. Terms such as "Fashion", "Denim", "Cotton", "Textile", "Boutique" and "Collection" carry no distinctiveness on their own, and the comparison is made on the core word remaining once they are stripped out.
The practical consequence: with an earlier "ARYA" on the register, an application for "ARYA FASHION" does not remove the similarity.
2. Name and surname marks
Naming a label after a designer is common in fashion. You may register your own name as a trademark; but if the same name is already registered by someone else it is an obstacle, and "it is my name" is not a defence on its own. See Can You Register Your Own Name?
3. The density of class 25
Class 25 is among the most heavily filed classes in Türkiye. The likelihood of a similar mark is high, which raises the risk of opposition.
A similar-mark search in class 25 before filing is therefore the only way to see the risk without paying fees. The search should not be confined to identical names but should cover marks close in pronunciation and spelling.
Label, Logo and Word
In clothing a mark appears in three places: on the woven label, in the print on the product, and on the shop sign. To cover all three, registering the mark as a word is generally more robust than registering a logo — a word registration survives a change of logo.
If the budget allows, taking both is the safest structure. If you must choose, start with the word mark: Can You Register Without a Logo?
Marketplaces and Export
The brand protection programmes of platforms such as Trendyol, Hepsiburada and Amazon may require your mark to be registered or applied for in the class of the goods you sell — that is, class 25. A class 35 registration alone may not be accepted: Which Class Does E-Commerce Fall Into?
If you export, remember that protection is territorial; a Turkish registration has no effect abroad. Take particular care if you have your goods manufactured overseas: Trademark Registration in China.
