Education and training services fall into class 41. The class covers courses, tutoring centres, schools, seminars and conferences, certification programmes, entertainment, sporting and cultural activities, and publishing.
Class 41 protects the service. At every point where you turn education into a product — a printed book, a downloadable application, a subscription platform — additional classes arise.

The 2026 Change
TÜRKPATENT Communiqué 2026/2 of 26 February 2026 brought the 13th edition of the Nice Classification into force and merged the first and second sub-groups of class 41.
This is a technical adjustment affecting the drafting of scope. For applications filed after 1 January 2026 the necessary adjustments are made by TÜRKPATENT of its own motion and free of charge; earlier registrations are not updated automatically.
Typical Structures
A course, tutoring centre or study centre
Class 41 alone. Sufficient if you do not print your own materials or sell digital products.
An institution printing its own books
41 + 16. Use of the mark on the book cover is protected by class 16; class 41 does not cover it.
An online education platform
41 + 42 (+ 9). The educational content is 41, the platform as a software service is 42, and a downloadable mobile app is 9.
A distinction is worth drawing here: for a site simply selling video lessons, 41 is the core; once you also license the platform to institutions (as an LMS), class 42 becomes the principal class. See Which Class Does Software Fall Into?

Sector-Specific Risks
1. Descriptiveness
Terms such as "Academy", "Education", "Course", "School", "College" and "Institute" carry no distinctiveness on their own. They are stripped out in the similarity assessment and the comparison rests on the remaining core word.
Names stating the subject directly are risky too: expressions like "English Course" or "Maths Academy" may be refused as descriptive.
2. Geographical and personal names
A city name is not distinctive on its own. Using the name of a scientist or historical figure requires separate assessment; applications containing another person's name may be refused upon that person's opposition.
3. Suggesting a public body
If the brand name creates the impression of a connection with an official public institution, deceptiveness may arise. For the full set of grounds see Why Are Trademark Applications Refused?
An Operating Licence Is Not a Trademark
Obtaining a licence to operate from the education authorities, or registering a trade name in the commercial registry, gives no trademark right over that name. These are different legal institutions and neither substitutes for the other: Trade Name, Business Name and Trademark.
The distinction becomes critical if you plan to open branches or grant franchises: if your mark is not registered, someone using the same name in another province may register it first and assert it against you.
Before You File
Class 41 is crowded and similar names are common in education. A similar-mark search before filing shows refusal and opposition risk before fees are paid.
